Department of Commerce (DOC) Bureau of Industry and Security (BIS) creates a ‘Military End User’ list starting with 102 companies In June 2020 BIS expanded license requirements on exports, reexports, and in-country transfers of items listed in Supplement No. 2 to part 744 of the EAR intended for “military end users” or “military end use” in China, Russia, or Venezuela. BIS is publishing a list of Military End Users (MEU) for the first time including 57 companies in China and 45 in Russia. BIS notes this list is not exhaustive and provides as an example, parties included on lists made public pursuant to Section 1237 of the National Defense Authorization Act FY99 (published by DOD as the list of Communist Chinese military companies), which raise a Red Flag under the EAR and require additional due diligence under part 744.21. |

Department of Commerce (DOC) Bureau of Industry and Security (BIS) removes Hong Kong as a separate destination under the Export Administration Regulations (EAR) pursuant to EO 13936 Based on this final rule, Hong Kong will be treated as part of China for export control purposes under the EAR and subject to the same license requirements, license exceptions and other applicable provisions. Note that because Hong Kong operates a separate customs and export control system from China, some references to Hong Kong will remain in certain provisions of the EAR. |
